facing a tax audit

A tax audit is a formal examination of an individual's or organization's tax returns and financial records by a government tax authority, such as the Internal Revenue Service (IRS) in the United States, to verify that the information provided is accurate and complies with tax laws. The audit process involves a detailed review of income, deductions, credits, and other tax-related transactions to ensure that the correct amount of tax has been reported and paid. If discrepancies or errors are found, the taxpayer may be required to pay additional taxes, interest, and possibly penalties. Tax audits can be triggered by various factors, including unusual deductions, high income, or random selection, and can range from a simple mail correspondence to an in-depth, in-person examination.

Filing an offer in compromise

An Offer in Compromise (OIC) is a program offered by the IRS, and also by New York State, that allows eligible taxpayers to settle their tax debt for less than the full amount owed, typically due to financial hardship, inability to pay, doubt as to collectibility, or special circumstances. Filing an OIC can provide significant financial relief by reducing the debt to an amount that is manageable, halting collection actions during the review process, and helping taxpayers achieve financial stability. Our experienced attorneys can guide you through both the federal and New York OIC processes, ensuring your offer is accurately prepared and effectively negotiated with the IRS and New York State tax authorities.

Contesting an IRS Notice of Deficiency in United States Tax Court

A Notice of Deficiency, often referred to as a "90-day letter," is issued by the IRS when it determines that you owe additional taxes. If you disagree with the IRS's assessment, you have the right to contest the deficiency in the United States Tax Court.

When the IRS issues a Notice of Deficiency, it signifies that the IRS believes you owe additional taxes, and you have 90 days (150 days if the notice is addressed outside the United States) to dispute the assessment before the IRS can begin collection efforts. Contesting the notice in the United States Tax Court allows you to present your case without first paying the disputed amount. This legal process ensures that taxpayers have a fair opportunity to challenge the IRS’s findings and present evidence in support of their position.
